Warranty

6.1 FRM guarantees the Products against any anomaly attributable directly and exclusively to defects in design, manufacture, workmanship or materials, within the terms of the law.

6.2 Ordinary Warranty: unless the Customer is not a Consumer (see below), FRM warrants in accordance with section 1490 cc et seq. that the Products are free from defects and the provisions of the Civil Code will apply.

The warranty will not be operative for defects caused by the Customer’s inappropriate use and/or negligence towards the Products or by accidents caused while the Customer is in possession of the Products or due to non-compliance with the instructions/warnings provided by FRM as well as in case of normal wear and tear of the Products. In case of replacement, the substituted nonconforming Product will remain the property of FRM.

FRM agrees to replace the Product or repair it, at its sole discretion, and shall not be liable to Customer for consequential damages and its liability shall be limited to no more than the value of the purchase price of the Products in question.

Repair or replacement of a defective item of supply will not vary the date of commencement of the warranty period for the supply as a whole.

6.3 CONSUMER: Pursuant to and for the purposes of the Consumer Code, FRM provides the Customer-Consumer with a legal warranty on the Product for any defect of conformity with respect to the sales contract that manifests itself within the term of 24 (twenty-four) months from delivery to the Customer-Consumer of the Product, as long as it is reported within 2 months from its discovery to the email address: service@frmbike.biz or by certified mail to the address indicated in the foregoing.

FRM, upon receipt of the complaint from the Customer-Consumer about a defect in the Product, will invite him/her to send suitable photographic documentation attesting to the damage and, in case of validity of the warranty, to ship at FRM the Product, which must be received without any sign of wear and tear, abrasion, scratch, deformation, etc., complete with all its elements and accessories, accompanied by the original wrapping and packaging and the warranty certificate, if any, and in any case in the condition in which it was received by the Customer-Consumer or, in any case, in normal state of preservation, insofar as it has been kept and possibly used with the use of normal diligence. Otherwise, the Customer-Consumer shall not be entitled to any refund.

Following verification of the returned Product by FRM, if the conditions are met, the latter will ask the Customer-Consumer whether it intends to have the good repaired or replaced free of charge or, if repair or replacement is impossible or excessively onerous, to obtain a price reduction or termination of the contract: in the first two cases, FRM will reimburse the Customer-Consumer for the shipping costs incurred in returning the Product and send him, as soon as possible and at no additional cost, a new Product or the Product actually ordered, if available; in the other two cases, in addition to the shipping costs, FRM will refund part of the price of the Product or the full price of the same.

All legal guarantees provided by the Consumer Policy Code remain valid.

Please note that shipments with charges borne by FRM will not be accepted outside of the cases described above and, therefore, without prior authorization from the same. Products received by FRM with charges borne by the recipient will be returned (unrepaired) with all costs, including return shipping costs, borne by the Customer.

6.5 Warranty Exclusion: The Customer is not authorized to repair independently or through mechanics not authorized by FRM, nor to unilaterally send the Products for repair or replacement without first contacting FRM Customer Service. The warranty will not be operative if the Customer or third parties carry out interventions, modifications or repairs without FRM’s prior written consent or if appropriate measures are not immediately applied to prevent aggravation of the damage.

The warranty is also excluded if the Customer fails to use and maintain the Products in accordance with the instructions in the Owner’s Manual.
